1. Acceptance of Terms

By accessing ComfortCool.com or purchasing products, you agree to these Terms of Service. If you disagree, please do not use our site. These terms apply to all visitors, customers, and Pro Portal members.

2. Purchases and Orders

By placing an order, you represent that you are at least 18 years old and have the legal capacity to enter a contract. All orders are subject to availability and our acceptance. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, inaccurate pricing, or inventory errors.

Once an order is placed, you will receive a confirmation email. This email is an acknowledgment, not an acceptance. A binding contract is formed when we ship your product.

3. Pricing and Payment

Prices are listed in US dollars and are subject to change without notice. We reserve the right to correct pricing errors even after an order has been placed. In such cases, we will notify you and allow you to confirm or cancel the order.

Sales tax will be applied to orders shipped to states where we are required to collect it. Payment must be received in full before shipment.

4. Shipping and Delivery

We ship within the continental United States. Estimated delivery times are provided at checkout and are estimates only — we are not responsible for carrier delays. Risk of loss and title pass to you upon delivery to the carrier.

For freight shipments (large fans), you must inspect the packaging upon delivery. Visible damage must be noted on the delivery receipt. Report damage within 48 hours to support@comfortcool.com.

5. Returns and Refunds

60-Day Free Returns: We offer a 60-day return window on all products. Items must be unused, uninstalled, and in original packaging. We arrange free pickup — no return shipping fees.

Installed products that have been connected to electrical systems cannot be returned under standard policy. If you experience a defect in an installed product, warranty service applies. To initiate a return, contact us at support or call 877-267-3205.

Refunds are processed within 5–7 business days of receiving the returned product in good condition. Pro Portal orders may have different return terms as specified in the Pro Agreement.

6. Warranty Terms

Products are covered by the manufacturer warranty described on each product page:

Warranties cover defects in materials and workmanship under normal use. Warranties are void if the product is improperly installed (not per included instructions), modified, misused, or damaged by acts outside normal operation. ComfortCool facilitates warranty claims with manufacturers but does not independently warrant third-party products beyond what manufacturers provide.

7. Installation Responsibility

Whole-house fans involve electrical and structural work. Installation must comply with local building codes. Many jurisdictions require a licensed electrician for electrical connections. ComfortCool is not responsible for improper installation, code violations, or damage resulting from installation errors.

Our installation guides are provided as general information only and do not constitute professional advice for your specific installation. When in doubt, hire a licensed professional.

All content on ComfortCool.com — including text, images, logos, configurator tools, and product descriptions — is owned by or licensed to ComfortCool, Inc. and is protected by copyright and trademark law. "Centric Air" and "QA Deluxe" are trademarks of their respective manufacturers.

10. Limitation of Liability

To the fullest extent permitted by law, ComfortCool shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising from your use of our site or purchase of products shall not exceed the amount you paid for the product in question.

Some states do not allow limitations on implied warranties or exclusion of consequential damages; in those states, our liability is limited to the extent permitted by law.

11. Dispute Resolution

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute that cannot be resolved informally will be submitted to binding arbitration under the AAA Consumer Arbitration Rules, conducted in San Diego County, California.

You waive the right to participate in class action lawsuits. Small claims court actions remain available to either party.
